A. Introduction

This Privacy Policy describes how and why the Utah Golf Association (the “UGA” or “we” or “us” or “our”) collects, stores, uses, and shares your personal information when you visit our website at https://www.uga.org (the “Website”) or engage with us at events or otherwise use our services (“Services”).

B. What personal information does the UGA collect and process?

The UGA collects two types of information when you access and use our Website or other Services:

  1. “Usage Data” is non-personal information collected automatically when you access and use the UGA’s Website or other Services. This information includes log and usage data, device data, and location data, which is primarily used to maintain the security and operation of our Services, and for our internal analytics and reporting purposes. This Usage Data cannot, in itself, be used to specifically identify or contact you.

  2. “Personal Data” is personal information about you that you voluntarily provide to us, or that otherwise comes into our possession through the choices you make or the products or services that you select or use, when you access and use the UGA’s Website or other Services. Personal Data may include (a) your contact information, such as your name, address, email address, telephone number, and/or UGA membership identification number; (b) demographic information, such as your age and gender; (c) golf background (such as whether you are an amateur or a professional, the name and address of your golf club or course, and your USGA Handicap Index; (d) username, password or other login credentials to create or access your account or accounts on the Website; (e) credit card information (if you make a purchase or donation through the Website); (f) health information (“Health Information”), if you submit a request through the Website to use a golf cart at a UGA championship or other UGA event); or (g) other information you submit when you contact us or post on the Website or other Services. The actual types of Personal Data collected depend on the specific products or services you request, the types of transactions you conduct on the Website, and the various activities in which you participate.

C. How Does the UGA Collect My Information?

The UGA uses tracking tools to automatically collect information, such as browser cookies, Web beacons, pixels or similar technologies. We collect information about users over time when they use the UGA’s Website or other Services or view our emails. We may also have third parties collect information this way, such as ad networks, web analytics companies, and social networking platforms.

We may collect information from you when you purchase goods and services, make a donation to the UGA, create an account, or contact us through the Website or other Services, submit an entry application to play in a UGA championship or other UGA-sponsored event, or submit other forms or information through the Website or other Services. We may also receive information about you from third parties, such as our business partners, service providers, and social media platforms.

Information obtained through the Website or other Services (including both Usage Data and Personal Data) may be combined and used in conjunction with information obtained through sources other than the UGA’s Website or other Services or at different times, including both offline and online sources and from third parties.

D. Use of Data

1. We use the collected data for various purposes, including the following:

  2. To respond to your inquiries and provide support to you;
  3. To understand your needs and interests and provide you with better products and services;

We may also disclose Usage Data regarding our users and user behavior as a measure of interest in, and use of, our Website and other Services to third parties, including, for example, aggregate data, such as overall patterns or demographic reports that do not describe or identify any individual user.

4. We will not disclose to third parties your Health Information or other sensitive information as defined under applicable law.

E. Third Party Advertisers

At times, some of the advertisers on the Website and their and our ad service providers (including affiliate network providers and third-party ad servers) may set cookies or use related technologies or web beacons when you view and/or click their advertising banners, links, or other ads. Information from cookies, tracking pixels, clear GIFs, and other tracking technologies placed through third party ads and links may be collected directly by those advertisers and ad service providers and used to cause relevant ads to be displayed to you. For example, these companies may collect and use information about you and your visits to our Website or other Services and other third-party websites in order to provide advertisements about goods and services of interest to you. These advertisements may appear on our Website and on other third-party websites. The advertiser’s privacy policy and/or that of its service provider will govern the use of this information. We are not responsible for the privacy practices of such companies.

F. How Does the UGA Try to Protect My Information?

The security of your information is important to us. However, while we strive to protect your information, due to the inherent open nature of the Internet, we cannot guarantee that communications between you and the UGA’s Website or other Services, or information stored on the UGA’s Website or server, will be free from unauthorized access by third parties such as hackers. You should be aware that any information and content, including Personal Data you post to the UGA’s Website, or other message boards, community tools, or other publicly accessible forums, may be viewed and used by anyone with access to such forums. By using the Website and any other Services, you assume the risk that the Personal Data provided by you may be viewed and used by third parties.

G. Retention of Data

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Website, or we are legally obligated to retain this data for longer time periods.

H. Transfer of Data

Your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, country or other jurisdiction where the data protection laws may differ from those of your jurisdiction. We value your trust in providing us your Personal Data and use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage, is 100% secure and reliable, and we cannot guarantee its absolute security.

J. Your Right to Withdraw Consent

The UGA will not discriminate against users exercising their privacy rights. Please note that we may ask you to verify your identity before responding to such request, and certain portions of our Service may become unavailable to you when our right to use your Personal Data has been withdrawn.

We may employ third-party companies and individuals to facilitate our Website and other Services (“Service Providers”), to provide the Services on our behalf, to perform Website-related services or to assist us in analyzing how our Website and other Services are used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

L. Analytics

We use Google Analytics to monitor and analyze the use of our Website. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. You can opt-out of having made your activity on the Website and other Services available to Google Analytics by installing the Google Analytics opt-out browser add-on. M. Payments

We may provide products and/or services on our Website that require payments, including but not limited to entry fees and membership renewals. In that case, we use third-party services for payment processing (e.g., a Payment Processor). Your payment information is provided directly to our third-party Payment Processor, NMI, whose use of your Personal Data is governed by that company’s privacy policy. NMI adheres to the highest standards set by PCI-DSS (as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover), helping ensure the secure handling of your payment information.

N. Links to Other Sites

Our Website may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third-party’s site. This Privacy Policy applies only to information collected by the UGA via its Website and other Services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

O. Children’s Privacy

We do not knowingly collect, solicit data from, or market to children under 13 years of age. We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from a child under 13 years of age without parental consent, we will take steps to remove that information from our servers.

By using our Website and other Services, you signify your agreement to the terms and conditions of this Privacy Policy.
